1onieczności wykonywania przez niego transakcji w systemie Administratora,</li><br><li><em>Karta płatnicza</em> – karta w rozumieniu art. 2 pkt. 15a ustawy o usługach płatniczych umożliwiająca dokonywanie transakcji płatniczych procesowanych przez Operatorów płatności na zasadach określonych w Regulaminie, która może zostać zarejestrowana przez Klienta - właściciela karty w Studio,</li><br><li><em>Operator płatności</em> – podmiot świadczący usługi płatnicze w ramach Oprogramowania, na zasadach opisanych w Regulaminie.</li></ul></section><section id="term" class="article-layout__content__section"><h2 class="lb-typography--headline6">2. Umowa</h2><ol class="lb-typography--body1c lb-color--secondary-item"><li>Zawarcie Umowy następuje poprzez wybranie karty płatniczej jako sposobu płatności za Abonament, wypełnienie danych karty oraz wyrażenia zgody na niniejszy dokument.</li><br><li>Umowa trwa dopóki Klient posiada konto w Oprogramowaniu lub do czasu, gdy Klient lub Administrator anuluje umowę, w zgodzie z postanowieniami niniejszego dokumentu.</li><br><li>Jeśli Klient zawiera umowę w imieniu firmy lub innej jednostki, oświadcza, że posiada pełnomocnictwo, aby reprezentować daną firmę oraz zaakceptować w jej imieniu niniejszy Regulamin.</li></ol></section><section id="card-registration" class="article-layout__content__section"><h2 class="lb-typography--headline6">3. Rejestracja karty płatniczej</h2><ol class="lb-typography--body1c lb-color--secondary-item"><li>W celu zarejestrowania Karty Płatniczej, Klient w ramach procesu płatności, podczas wyboru metody płatności powinien podać dane Karty Płatniczej (16 lub 19-cyfrowy numer Karty Płatniczej, datę ważności Karty Płatniczej, kod CVV/CVC) oraz zapoznać się z zasadami świadczenia usługi i zaakceptować postanowienia niniejszego Regulaminu.</li><br><li>Klient dokonując akceptacji postanowień niniejszego Regulaminu wyraża zgodę na rejestrację Karty Płatniczej w trakcie procesu płatności.</li><br><li>Prawidłowa rejestracja Karty Płatniczej skutkuje zapisaniem zaszyfrowanych danych Karty Płatniczej (4 ostatnie cyfry numeru karty płatniczej oraz data ważności karty) w Studio Klienta i umożliwia Administratorowi cykliczne obciążanie rachunku Klienta. Zasady składania reklamacji</h2><ol class="lb-typography--body1c lb-color--secondary-item"><li>Klient ma prawo w każdym czasie złożyć reklamację jeśli usługi przewidziane w niniejszym Regulaminie nie są realizowane przez Administratora lub są niezgodne z postanowieniami Regulaminu.</li><br><li>Reklamacje należy składać za pośrednictwem poczty elektronicznej na adres <a href="mailto:[email protected]">[email protected]</a> lub za pośrednictwem formularza kontaktowego dostępnego poprzez Serwis Administratora.</li><br><li>Reklamacja powinna zawierać: <ul class="lb-typography--body1c lb-color--secondary-item" style="list-style-type:lower-latin;"><br><li>imię i nazwisko Klienta,</li><br><li>nazwę Studio Klienta,</li><br><li>opis zdarzenia lub przedmiotu reklamacji,</li><br><li>adres poczty elektronicznej, na który ma zostać przesłana odpowied

1ź.</li></ul></li><br><li>Administrator rozpatruje reklamacje w terminie 14 dni roboczych od dnia otrzymania reklamacji od Klienta, chyba że Klient: <ul class="lb-typography--body1c lb-color--secondary-item" style="list-style-type:lower-latin;"><br><li>nie opisał przedmiotu reklamacji w sposób umożliwiający je rozpatrzenie,</li><br><li>nie podał danych umożliwiających identyfikację Klienta,</li><br><li>nie podał innych wymaganych danych.</li></ul></li><br><li>W przypadku, o którym mowa w punkcie 6.4.a – 6.4.b termin na rozpatrzenie reklamacji zaczyna się od dnia, w którym Klient dostarczy Administratorowi brakujące informacje.</li><br><li>W szczególnie skomplikowanych przypadkach termin, o którym mowa w punkcie 6.4 może ulec wydłużeniu do 30 dni roboczych. Zwycięstwa 241/13, 81-521 Gdynia, Poland, email: [email protected], operating under EU VAT number PL7532294721, offering online Services and Application,</li><br><li><em>Client</em> – means an entity with a sufficient legal capacity, under the provisions of national legislation, to be subject to rights and obligations, which demands the performance of the Service from the Service Provider by filling the electronic registration form available on the Service Provider’s Website,</li><br><li><em>Agreement</em> – means the Terms and Conditions and any additional documents provided by the Service Provider,</li><br><li><em>Subscription</em> – the fee paid by the Client at the end of each billing cycle for using the Application and/or Service,</li><br><li><em>Application</em> – online booking and management system created and offered by the Service Provider,</li><br><li><em>Additional Services</em> – Services used by the Client outside of the regular Offer,</li><br><li><em>Billing Cycle</em> – specified time period, between the first and the last day of the month, for which a subscription is being charged,</li><br><li><em>Recurring Payment</em> – allows for automatically charging the Client for Subscription on a monthly schedule,</li><br><li><em>Payment Card</em> – is a card issued by a financial company which can be used as payment for Services offered by the Service Provider in line with this Agreement, which can be registered by the Client - the cardholder,</li><br><li><em>Payment Operator</em> – allows the Service Provider for accepting electronic payments by a variety of payment methods including credit card or debit card.</li></ul></section><section id="term" class="article-layout__content__section"><h2 class="lb-typography--headline6">2. Subject of the Agreement</h2><ol class="lb-typography--body1c lb-color--secondary-item"><li>When Client selects Recurring Payment as a payment method, provides his Payment Card 

1information and agrees to this Agreement, the Agreement between Client and the Service Provider is formed, and the term of the Agreement will begin.</li><br><li>The Agreement will continue for as long as the Client has a Fitssey account or until the Service Provider terminates the Agreement.</li><br><li>If the Client signs up for the Service on behalf of a company or other entity, he represents and warrant that he has the authority to accept any terms and enter into the Agreement on its behalf.</li><br></ol></section><section id="card-registration" class="article-layout__content__section"><h2 class="lb-typography--headline6">3. Payment Card Registration</h2><ol class="lb-typography--body1c lb-color--secondary-item"><li>To register a card, Client needs to fill in his Payment Card data (16 or 19-digit payment card number, expiration date, CVV/CVC code) during the payment process by choosing an appropriate payment method and accept this Agreement.</li><br><li>Client, by accepting this Agreement agrees for his Payment Card data to be registered in the Application in an encrypted form.</li><br><li>Successful card registration results in storing encrypted Payment Card data (last 4 digits of the card number and card expiration date) in Client&#39;s Studio and allows the Service Provider to automatically charge the Client for Subscription on a monthly schedule. The Administrator does not store the CVV/CVC code.</li><br><li>Client is obliged to provide true, accurate and complete data and immediately update his data in case of any change to use the service.</li><br><li>Client has the ability to independently manage his Payment Cards, i.e., can register new cards and remove the existing ones.</li><br><li>Payment transactions carried out inside the Application with the use of a Payment Card are operated by the Payment Operators allowing the Service Provider for accepting electronic payments in line with this Agreement.</li><br><li>Using the service does not require and does not result in opening a bank account or a payment account.</li></ol></section>',3),Oe={id:"payment",class:"article-layout__content__section"},Te=e("h2",{class:"lb-typography--headline6"},"4. Filling a complaint</h2><ol class="lb-typography--body1c lb-color--secondary-item"><li>Client has the right to raise a complaint at any time if the service provided by the Service Provider is not in line with this Agreement.</li><br><li>Complaints should be sent via email to <a href="mailto:[email protected]">[email protected]</a> or via a contact form available through Service Provider’s Website.</li><br><li>The complaint should consist of: <ul class="lb-typography--body1c lb-color--secondary-item" style="list-style-type:lower-latin;"><br><li>Client’s name,</li><br><li>Client’s studio name,</li><br><li>description of the issue or subject of the complaint,</li><br><li>email address, to which the response should be sent.</li><br></ul></li><li>Service provider shall investigate a complaint within 14 working days, unless the Client: <ul class="lb-typography--body1c lb-color--secondary-item" style="list-style-type:lower-latin;"><br><li>did not describe the subject of the complaint in a proper way,</li><br><li>did not provide details that would enable Client’s identification,</li><br><li>did not provide other required information.</li><br></ul></li><li>In cases listed in section 6.4.a – 6.4.b the time for investigating the complaint starts on the day on which the Client provides details which enable the Service Provider to investigate the complaint.</li><br><li>In specific/complicated situations, the time mentioned in 6.4 can be extended to 30 working days.
