Participating clubs and event organisers provide the venue and may offer related services under their own terms.'})]}),e.jsx(a,{title:"2. Accounts and eligibility",children:e.jsx("p",{className:"leading-relaxed",children:"You must be at least 18 to create an account or purchase the Service unless a parent or guardian authorises an account for a minor. You must provide accurate contact information, protect your account and promptly report suspected misuse. You may not impersonate another person or use an account to avoid access, payment or enforcement controls."})}),e.jsxs(a,{title:"3. Recording, Start and Claim After",children:[e.jsx("p",{className:"leading-relaxed",children:"At an enabled court, a court device may maintain a short rolling video and, where notified, audio buffer. This allows a participant to start a recording before or during play or claim a recent match afterwards. A compatible third-party camera may be used as the video source without changing this workflow."}),e.jsx("p",{className:"leading-relaxed",children:"Where audio is enabled, the microphone is directed at the playing area and is not intended to capture sound from surrounding areas."}),e.jsx("p",{className:"leading-relaxed",children:"Before a valid Start or Claim, unclaimed footage remains on the court device, is not ordinarily available for browsing, is not uploaded to the cloud, is not used for AI-model training and is automatically overwritten or deleted within 24 hours."}),e.jsx("p",{className:"leading-relaxed",children:"A Start or Claim selects the relevant segment for upload and use through Svila. By Starting or Claiming, you confirm that:"}),e.jsxs(i,{children:[e.jsx("li",{children:"you participated in the match or are authorised to act for the permitted purpose;"}),e.jsx("li",{children:"you selected the correct club, court and time;"}),e.jsx("li",{children:"the other participants have been informed about the recording and intended use; and"}),e.jsx("li",{children:"you will follow the venue notice, these Terms and applicable law."})]}),e.jsx("p",{className:"leading-relaxed",children:"You cannot give data-protection consent on behalf of another adult. Your confirmation is an account and anti-abuse obligation; the legal bases for processing are explained in the Privacy Policy."}),e.jsx("p",{className:"leading-relaxed",children:"Where enabled, authorised Club or Svila personnel may initiate or assist with a Claim for player service, support, a specific venue incident, an event or another documented permitted purpose. Relevant administrator actions may be logged. This does not give personnel unrestr

Access, privacy and complaints",children:[e.jsx("p",{className:"leading-relaxed",children:"Claimed recordings are private by default. They may be accessed by authorised participants, people you invite through available sharing features, and personnel who reasonably need access for support, service delivery, security, rights requests or an authorised Club workflow."}),e.jsxs("p",{className:"leading-relaxed",children:["If you appear or are heard in footage and believe it was wrongly Claimed, accessed or published, contact"," ",e.jsx("a",{href:"mailto:[email protected]",className:"text-primary hover:underline",children:"[email protected]"}),". We may restrict access or sharing while reviewing a credible report and may remove, unpublish or delete content where appropriate. Sharing, public content and Club use",children:[e.jsx("p",{className:"leading-relaxed",children:"Where available, you may invite genuine participants, create a share link, download authorised content or publish selected content. You are responsible for people to whom you send a link or copy. Before making identifiable people public, you must have the authority or permissions required for the selected audience and respect valid objections."}),e.jsx("p",{className:"leading-relaxed",children:"Content may be made available in a Svila public library, on Club TV, through a public event or on external channels where the relevant feature, event notice or marketing permission covers that use. Publishing a highlight does not automatically publish the full match or authorise every unrelated use."}),e.jsx("p",{className:"leading-relaxed",children:"A Club may claim and use recordings for player service, event coverage, tournament promotion or Club marketing where the purpose has been communicated and the Club has the lawful basis and permissions required for that use. Public events may have separate recording, livestreaming and publication rules disclosed before participation. Additional safeguards apply to minors."})]}),e.jsxs(a,{title:"6. AI analysis and product improvement",children:[e.jsx("p",{className:"leading-relaxed",children:"Svila or an approved service provider may process Claimed Match Footage to create highlights, statistics and sports insights. Results may be incomplete or inaccurate and are informational only. They are not medical, safety, employment or professional advice."}),e.jsx("p",{className:"leading-relaxed",children:"SmartCourt may use Claimed Match Footage, selected frames, segments, metadata and derived sports data to provide, test, develop and improve Svila's sports-recording, highlight-generation and analysis technologies, including AI and computer-vision models. Approved providers may assist and may evaluate and improve the sports models used to provide their analysis through Svila, within the contractually defined purpose and restrictions. We do not use Unclaimed Footage for model training. The Privacy Policy explains the legal basis, safeguards and right to object."})]}),e.jsxs(a,{title:"7. Purchases and refunds",children:[e.jsx("p",{className:"leading-relaxed",children:"A participating Club may offer both checkout through Svila, including through a Merchant of Record, and direct Club sales for different products or purchase flows. The seller identified for each transaction is responsible for that sale, including pricing, taxes, refunds and mandatory consumer information. If a Club sells a service directly, its sale and refund terms apply to that transaction."}),e.jsx("p",{className:"leading-relaxed",children:"Regardless of who takes payment, access through Svila requires a Svila account and acceptance of these Terms. After a direct Club sale, an authorised Club manager may use the Club Manager Dashboard to unlock the selected recording for the customer's Svila account. The customer must create or sign in to that account and acknowledge the Privacy Policy before accessing the recording."}),e.jsx("p",{className:"leading-relaxed",children:"You purchase a limited digital-access right, not ownership of Svila, its technology, or the personal data and rights of other participants. Mandatory consumer rights remain unaffected."}),e.jsx("p",{className:"leading-relaxed",children:"We may send necessary recording-ready, payment, security and support messages to the email address, phone number, WhatsApp account or other channel you select where that channel is available. Optional promotional messages use a separate preference or another basis permitted by applicable communications law."})]}),e.jsxs(a,{title:"8. Intellectual property and licences",children:[e.jsx("p",{className:"leading-relaxed",children:"SmartCourt and its licensors retain all rights in the Svila platform, devices, software, interfaces, branding, algorithms, AI models and generic technology. We grant you a limited, non-exclusive, non-transferable right to use the Service and authorised content during the applicable access period."}),e.jsx("p",{className:"leading-relaxed",children:"You grant SmartCourt the non-exclusive rights reasonably needed to host, store, reproduce, display, transmit, stream, distribute to the audience you select, format, analyse and process Claimed Match Footage and to create and improve Service outputs as described

Acceptable use",children:[e.jsx("p",{className:"leading-relaxed",children:"You must not:"}),e.jsxs(i,{children:[e.jsx("li",{children:"Claim unrelated footage or misrepresent your authority;"}),e.jsx("li",{children:"access, publish or use another person's private recording unlawfully;"}),e.jsx("li",{children:"harass, stalk, dox, defame or unlawfully monitor anyone;"}),e.jsx("li",{children:"circumvent payment, access, rate-limit or security controls;"}),e.jsx("li",{children:"use malware, scraping or unauthorised automated extraction;"}),e.jsx("li",{children:"attempt to identify people from information presented as anonymous;"}),e.jsx("li",{children:"use Svila content, software or outputs to train or build a competing service without our written permission and a lawful basis; or"}),e.jsx("li",{children:"otherwise violate applicable law, venue rules or another person's rights."})]})]}),e.jsxs(a,{title:"10. Availability and retention",children:[e.jsx("p",{className:"leading-relaxed",children:"The Service depends on venue equipment, power, connectivity, cloud services and other providers. We do not guarantee perfect capture, uninterrupted availability or error-free analytics. Svila is a sports recording and analysis service; using a camera that can also be used for security does not give anyone broader surveillance rights."}),e.jsx("p",{className:"leading-relaxed",children:"Unclaimed local footage is deleted within 24 hours. Claimed footage, outputs and links are retained for the period shown in the Service or Privacy Policy and may expire or be deleted. Suspension and liability",children:[e.jsx("p",{className:"leading-relaxed",children:"We may restrict content, revoke links, suspend or terminate access to address a false Claim, privacy complaint, payment abuse, security risk, legal requirement or material breach. Where appropriate, we will provide notice and a reasonable review route."}),e.jsx("p",{className:"leading-relaxed",children:`To the fullest extent permitted by law, the Service is provided "as available". Nothing excludes liability or consumer rights that cannot lawfully be excluded. Subject to those rights, SmartCourt's aggregate liability for the consumer Service is limited to the greater of EUR 100 or the amount you paid for the Service in the 12 months before the event giving rise to the claim. You may not transfer your account or these Terms without our consent.
